Pennsylvania-based Air Products and Chemicals Inc. recently paid $184,284 in back wages to 38 employees who were denied overtime pay, the U.S. Department of Labor’s Wage and Hour Division (WHD) announced. WHD investigators found that employees at the company’s facilities in Reserve and Milton, Wisconsin were working up to 62 hours per week without overtime pay in violation of the Fair Labor Standards Act (FLSA).

The company paid $86,313 to 16 employees in its Reserve facility and $97,971 to 22 workers in Milton. The WHD assessed an additional $2,090 in civil penalties because of prior FLSA violations in an Air Products’ facility in Haysville, Kansas. The company paid $95,564 to 20 employees to resolve those charges.
In addition to paying back wages, Air Products agreed to bring its policies and practices into compliance with the FLSA.
“We assessed penalties against the employer because this is the second time we found this company in violation of the FLSA,” said Cynthia Watson, WHD regional administrator. “This case should remind all employers to take their legal obligations seriously and implement procedures or safeguards to ensure employees, especially those who work overtime hours, are paid properly for their work.”
