Florida’s minimum wage will rise by 36 cents to $7.67 per hour effective January 1, 2012, 42 cents higher than the federal minimum wage of $7.25. The minimum direct wage for tipped employees will rise to $4.65.

Florida law requires the Florida Department of Economic Opportunity (DEO) to adjust the state minimum wage annually to reflect increases in the federal Consumer Price Index for Urban Wage Earners and Clerical Workers in the South Region for the year ending September 1, 2011. The minimum wage applies to all employees in the state who are covered by the federal Fair Labor Standards Act (FLSA).

According to the U.S. Department of Labor’s Wag and Hour Division, Florida is one of 18 states that impose a minimum wage higher than the federal minimum wage. Twenty-three states have a minimum wage equal to the federal minimum wage, and five states do not have an established minimum wage. Florida is one of ten states that link the minimum wage to the consumer price index.
