Justice Department Asks Supreme Court to Hear Healthcare Reform Case

The Justice Department has asked the United States Supreme Court to review the 11th Circuit Court of Appeals ruling against the Affordable Care Act (ACA).

In a 2-1 decision, the 11th Circuit Court of Appeals found the ACA’s “individual mandate” provision, which requires individuals who fail to maintain adequate health insurance coverage to pay a penalty, was unconstitutional.

Two other federal courts of appeal have issued decisions on the law. The Sixth Circuit ruled in favor of the ACA, finding the individual mandate provision constitutional. The Fourth Circuit also ruled in favor of the healthcare reform law, vacating a lower court’s ruling against the law.

In addition, the United States Court of Appeals for the District of Columbia recently heard arguments on the constitutionality of the law.

It’s likely the Supreme Court will agree to hear arguments.
