Six Parts of the Tax Levy Form

During a BLR webinar presentation entitled ‘Payroll: How to Legally Handle Tax Levies and Garnishments’, Attorneys Clint Robison and Amy Jensen, discussed the form provided by the Internal Revenue Service (IRS) for tax levies. This form is known as Form 668W Notice of Levy on Wages, Salary, and Other Income. The form has six parts:

  • Part 1 of the form is for the employer or other addressee and contains identifying details of the notice such as the date of the notice , the name of the taxpayer, the address of the tax payer, the telephone number for the IRS and the reply address for the IRS
  • Parts 2-5 are given to the Employee
  • Parts 3 and 4 must be returned to the employer within three days
  • Part 3 eventually goes to the IRS
  • Part 4 stays with the employer
  • Part 5 is the employee’s copy
  • Part 6 is retained by the IRS
